Aarda AI is an interactive storytelling platform that enables users to:

4. User Conduct and Responsibilities

4.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not:

Prohibited Activities:

Violate any applicable laws or regulations
Infringe on intellectual property rights of others
Upload malicious software, viruses, or harmful code
Attempt to gain unauthorized access to our systems or other users' accounts

5. Intellectual Property Rights

5.1 Our Intellectual Property

The Service and its content, features, and functionality are owned by us and protected by intellectual property laws. This includes:

Platform software and algorithms

Proprietary AI models and systems
Service design and user interface
Documentation and help materials

5.2 Your Content

You retain ownership of content you create and upload to the Service. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, distribute, and display your content solely for providing and improving the Service.

5.3 AI-Generated Content

Content generated by our AI systems is subject to the following:

You may use AI-generated content for your personal and commercial purposes
We make no representations about originality or intellectual property status
You are responsible for ensuring your use complies with applicable laws
Some AI-generated content may be similar to content created by others
AI-generated content may be based on training data that includes copyrighted material

6. Billing and Payments

6.2 Billing Cycles

Subscriptions are billed in advance on a monthly basis. Billing cycles begin on the date you subscribe and renew automatically unless cancelled.

6.3 Usage-Based Charges

Certain features may incur additional charges based on usage:

Tokens: Charged per 1,000 tokens used for AI interactions and content generation
Audio: Charged per minute of audio generation/transcription
Images: Charged per AI-generated image using DALL-E and other services
Characters: Charged per character created beyond plan limits

6.4 Payment Terms

Payment is due immediately upon billing
We accept major credit cards and other payment methods as available
Failed payments may result in service suspension
You are responsible for all taxes and fees
All charges are non-refundable unless specifically stated

6.8 Refunds

All payments are generally non-refundable. However, we may provide refunds in the following circumstances:

Service unavailability for extended periods due to our technical issues
Billing errors on our part
As required by applicable law
At our sole discretion for exceptional circumstances

Refund requests must be submitted within 30 days of the charge and will be reviewed on a case-by-case basis.

Our AI services are powered by machine learning models that:

May produce inaccurate, biased, or inappropriate content
Cannot guarantee originality or factual accuracy

AI-generated content does not constitute professional advice of any kind, including:

Legal, medical, or financial advice
Professional consultation or recommendations
Factual information or research
Therapeutic or counseling services

7.3 User Responsibility for AI Content

You are solely responsible for:

Reviewing AI-generated content before use
Verifying accuracy and appropriateness
Ensuring compliance with applicable laws
Any consequences of using AI-generated content

7.5 Third-Party AI Services

Our Service integrates with third-party AI providers (including OpenAI, Google, and ElevenLabs). These services are subject to their own terms and limitations.

WE MAKE NO WARRANTIES REGARDING AI-GENERATED CONTENT, INCLUDING:

ACCURACY, COMPLETENESS, OR RELIABILITY
ORIGINALITY OR INTELLECTUAL PROPERTY STATUS
SUITABILITY FOR ANY PARTICULAR PURPOSE
COMPLIANCE WITH APPLICABLE LAWS OR REGULATIONS

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. The courts of Stockholm, Sweden shall have exclusive jurisdiction over any disputes arising under these Terms.

12.2 Arbitration Agreement

Binding Arbitration

Subject to the exceptions below, you and Aarda AI agree that any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Service shall be settled by binding arbitration rather than in court.

Arbitration Rules

The arbitration shall be administered by the Arbitration Institute of the Stockholm Chamber of Commerce (SCC) under the SCC Arbitration Rules then in effect. The arbitration shall be conducted in Stockholm, Sweden, in the English language.

Arbitrator Selection

The arbitration shall be conducted before a single arbitrator unless the amount in controversy exceeds EUR 100,000, in which case the arbitration shall be conducted before three arbitrators.

Class Action Waiver

You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or class member in a class, consolidated, or representative action.

Exceptions to Arbitration

Either party may bring suit in court for:

Injunctive relief to stop unauthorized use or abuse of the Service or infringement of intellectual property rights
Small claims court matters (if they qualify)
Disputes that cannot be arbitrated under applicable law

12.3 Limitation of Time to File Claims

Any claim or dispute arising under these Terms must be filed within one (1) year after such claim arose, or it will be forever barred.
